Conditional Use
Description: Although each zoning district is primarily intended for a predominant type of land use, there are a number of uses that may be appropriate under certain conditions. These are referred to as “conditional uses.”  Section 170.350 of the zoning code describes the requirements and procedures for reviewing a conditional use, including an amendment of an approved conditional use.

Initiation: The owner of the subject property may submit an application for the establishment of a conditional use or an amendment to a prior approval

Decision maker(s): Plan Commission makes a recommendation and the Village Board makes the final decision

Review process:
  1. Pre-submittal meeting. Before submitting an application, the applicant or the applicant's agent should meet with the zoning administrator to review (1) applicable regulations and procedures, (2) applicable sections of the Village's comprehensive plan, and (3) the proposal. Upon request, the Zoning Administrator may waive the requirement to hold a presubmittal meeting when he or she determines such meeting is not necessary given the nature of the project and/or the extent to which the applicant understands the Village's zoning requirements.
  2. Submittal of application materials. The applicant submits a completed application and other required materials to the zoning administrator along with the application fee as may be established by the Village Board.
  3. General notice. The zoning administrator publishes a class 2 public notice and sends out a written notice to all property owners within 300 feet of the subject property.
  4. Public hearing. Allowing for proper notice, the Plan Commission conducts a public hearing.
  5. Recommendation. After the public hearing has been closed, the Plan Commission makes a recommendation to the Village Board to (1) approve the conditional use, (2) approve the conditional use with conditions, or (3) deny the conditional use.
  6. Decision. The Village Board makes a final decision to (1) approve the conditional use, (2) approve the conditional use with conditions, or (3) deny the conditional use.
  7. Notification of decision. Within a reasonable time following the Village Board’s decision, the zoning administrator shall mail the decision notice to the applicant by regular mail.
  8. Public record copy. A duplicate copy of the decision notice shall be retained as a public record.

Notes:
  1. In order for an application to be heard on a given meeting date, the application (including forms, fees, plans, reports, etc.) must be submitted AND deemed complete by Village staff on or before the corresponding submittal date. Because of that, you should submit your application before the submittal date. That way, we may be able to let you know if anything is missing and you'll have some time to perhaps get it done before the deadline.
  2. Meeting dates and their corresponding submittal dates are subject to change.
