Zoning Code Amendment

Description: From time to time, it may be necessary or desirable to amend the text of the zoning code and the zoning map. Procedures and requirements are found in Section 170.300 of the zoning code.

Initiation: Any of the following may submit an application to amend the zoning code (map and/or text):

a property owner in the area to be affected by the proposed amendment,
the Plan Commission,
the Village Board, and
the Board of Zoning Appeals

Decision maker(s): Plan Commission makes a recommendation and the Village Board makes the final decision. If the amendment revises the floodplain boundary, the DNR and FEMA must also review and approve the change before it becomes effective.

Review process:

Submittal of application materials. The applicant shall submit a complete application to the zoning administrator along with the application fee as may be established by the Village Board.
Recommendations. The Village Plan Commission shall review all proposed changes and amendments within the corporate limits and shall recommend that the petition be granted as requested, modified, or denied. The recommendation shall be made at a meeting subsequent to the meeting at which the petition is first submitted and shall be made in writing to the Village Board.
Hearings. The Village Board shall hold a public hearing upon each recommendation, and shall give notice as specified in section 70.45.
Village Board's action. Following such hearing and after careful consideration of the Village Plan Commission's recommendations, the Village Board shall vote on the passage of the proposed change or amendment.
Preparation of new zoning map. The zoning administrator shall cause a new zoning map to be prepared, if the amendment involves a change to the zoning map.

The review process for a development application includes a public hearing. What's that?

A public hearing is intended to allow the petitioner the opportunity to describe their proposed project and interested parties the opportunity to share their concerns with the reviewing authority. While all public comments are welcome, speakers should focus on those elements of the project that are within the review authority's scope of authority. Consistent with established policies, public comments may be limited in duration to make sure everyone can be heard.

What is a determination of completeness?

When we receive a development application, staff will review the materials to make sure the application submittal is complete and ready for formal review. If an application submittal is not complete, staff will notify the applicant and describe the parts that are not complete.

A determination that an application is complete means the application is ready for formal review and does not suggest the applicant has provided sufficient information in all regards or preclude the reviewing authority from requesting additional information it deems appropriate.

Can a decision of the Village Board be appealed?

Yes; appeals are made to the circuit court and generally must be filed with the court soon after the decision has been made.
