Zoning Code Amendment
Description: From time to time, it may be necessary or desirable to amend the text of the zoning code and the zoning map. Procedures and requirements are found in Section 170.300 of the zoning code.

Initiation: Any of the following may submit an application to amend the zoning code (map and/or text):
  1. a property owner in the area to be affected by the proposed amendment,
  2. the Plan Commission,
  3. the Village Board, and
  4. the Board of Zoning Appeals

Decision maker(s): Plan Commission makes a recommendation and the Village Board makes the final decision. If the amendment revises the floodplain boundary, the DNR and FEMA must also review and approve the change before it becomes effective.

Review process:
  1. Submittal of application materials. The applicant shall submit a complete application to the zoning administrator along with the application fee as may be established by the Village Board.
  2. Recommendations. The Village Plan Commission shall review all proposed changes and amendments within the corporate limits and shall recommend that the petition be granted as requested, modified, or denied. The recommendation shall be made at a meeting subsequent to the meeting at which the petition is first submitted and shall be made in writing to the Village Board.
  3. Hearings. The Village Board shall hold a public hearing upon each recommendation, and shall give notice as specified in section 70.45.
  4. Village Board's action. Following such hearing and after careful consideration of the Village Plan Commission's recommendations, the Village Board shall vote on the passage of the proposed change or amendment.
  5. Preparation of new zoning map. The zoning administrator shall cause a new zoning map to be prepared, if the amendment involves a change to the zoning map.

Notes:

In order for an application to be heard on a given meeting date, the application (including forms, fees, plans, reports, etc.) must be submitted AND deemed complete by Village staff on or before the corresponding submittal date. Because of that, you should submit your application before the submittal date. That way, we may be able to let you know if anything is missing and you'll have some time to perhaps get it done before the deadline.
  2. Meeting dates and their corresponding submittal dates are subject to change.
